Last week’s rando lyrics: The lyric, “Everyone I know is slowly falling into the ocean” is from the song "Telepath”, a single cover by the group Jimmy Eat World, of a song written by Andy Hull and Robert McDowell of Manchester Orchestra. It is Track 6 on the Manchester Orchestra album “The Million Masks of God” released in February 2021. The Jimmy Eat World version was released February 2023 as a cover and produced by Jimmy Eat World. The original by Manchester Orchestra was produced by Robert McDowell, Andy Hull, Ethan Gruska & Catherine Marks. (Note the “Mutual Covers” link below for more of the story…)

Ed Sheeran Vs Heirs Of Marvin Gaye Ruling Affirmed See Also: Reuters Article
The Ed Sheeran litigation with the Heirs Of Marvin Gaye resulted in a trial court ruling that essentially held chord progressions could not be copyrighted. The case was more complicated than that, but for our purposes here, it was an extremely important result. Essentially, had the case been decided in the Heirs favor and that result affirmed by higher courts, every songwriter who used practically any chord progression would owe every previous songwriter who used any chord progression, unique or common, a portion of royalties. Eventually, every songwriter would owe royalties to every other songwriter (or their heirs/assigns) who came before them. Potentially.
That result, absurd on it’s face, should never have even made it to trial, but it did, and the correct result was obtained. Now a Federal appeals court has upheld that verdict via dismissal, and although there are other adjacent cases on the subject matter still pending, this result should be dispositive of most, if not all of them. For now it’s precedent in the Federal 2nd Circuit for appeals, but certainly persuasive everywhere. See the links above for details. I kinda doubt it will make it to the Supremes for a decision, but I’ll let you know if I see it.

A Song To Play…
4/4 common time, a very quick 187 BPM in the Key of DMajor, and using them all - the only chord in the key not used is the C#diminished, the vii(diminished) chord, though the non-diatonic Gm (a iv-, kinda unusual…) certainly is an interesting choice (assuming Chordify actually heard that…).
The song uses 3 barre chords, the familiar Bm and F#m, and the Gm (diagram above). If you’re confident with the Bm and F#m (if not, practice now until you are - you’ll be glad I nagged you about this someday…), the Gm is the same shape as the F#m, just one fret toward the soundhole. I say it that way because up and down on the fretboard in theory is simple to grasp, but when you’re playing it’s kinda left and right, so “toward the soundhole/bridge/saddle/pickups/tailpiece” or “toward the headstock” are better guides. More or less.
